Re: 20 year old felony blocking purchase of gun
I have an aquaintence that went to prison for car theft, when he waws younger. Turned his life around for a number of years, and got a presidential pardon that took all that off his records. He now can vote and own guns, and enjoys the shooting sports.
If you have anyone in the judicial system that can maybe petetion the President. they get that sort of stuff all the time.

Re: 20 year old felony blocking purchase of gun
Im in California also and have heard of felons getting there rights reinstated as mentioned on the post from Americangirl. But I would probabaly focus on getting all my rights reinstated not just the one to own a gun. Judge might just be more willing to help out of he know that not all your doing is wanting to run out and purchase a firearm!

"Expunged" just wont cut it. The DOJ can still see it. The judge did allow for a "expungment", in fact, all I have to do is submit the documents to the clerk, but he wouldnt remove it completely.
I called the DOJ regarding what I am allowed to use as a self defense weapon, but have yet to reach someone. I wouldnt be surprised if I'm left with little more than spit-wads.
Thanks again all.

How about a speargun, are those allowed? then there are crossbows, though I admit hey aren't just real concealable. Maybe this is accademic, but if Obama gets elected, a lot of folks will have illegal guns, if misery likes company.

Stinkbomb: the-unforgiven:
Yes, but let the punishment fit the crime..never mind the 20 years. I cant believe that its even considered a "felony", much less that you cant purchase a gun because you decided to dabble in drugs. It makes sense if the person had a violent background, even domestic violence..but drugs?
I don't think I can agree with you 100% on that. A felony is a felony so I find it hard to give pity. I have seen drug addicts that need drugs and if they owned a gun they would not think twice about hurting somebody to get them. I'm not saying you still do drugs, I don't know you, but how do you draw a line like that? How many criminals on death row are suddenly born-again christians?
I have a sister theat sniffed paint thinner for years, she had problems.Seeing flying macaroni YES I SAID FLYING MACARONI among other things. 25 years ago I would not put a straw and spit wads in her hands. Today she has been clean of all liquids for 2 decades and I wuold have no problem with her owning a firearm. People can claen up their act, change their ways. I myself have done stupid things a a kid,we all did. These cases(minor drug offences )should be on a case by case basis, violent crimes ,murder and such proly should be a life time ban.
If you want them here, you support them.

Re: 20 year old felony blocking purchase of gun
Although I do agree that some cases, perhaps yours, should be individually reviewed and cleared I don't think it should be an easy process. If it is made too easy then the sleaze ball lawyers will use it to ill gain for BGs. This could lead to fodder for the fire against gun ownership in general. It's like everyone says, probably only difference between you and us is the luck about getting caught or not. Good luck with your indeavour.
Everyone brings joy to this place. Some when they enter and some when they leave!

Re: 20 year old felony blocking purchase of gun
You need to apply for a pardon from the Gov. office of your state.
There's a lot of paperwork like giving them your credit report but if you have stayed clean for 20 years you should have no problem. Once you get the pardon you can legally purchase a firearm. You can then (if you want to) try and get the felony expunged from your record. You don't have to do this though.

Your Quote:
"Yes, but let the punishment fit the crime..never mind the 20 years. I cant believe that its even considered a "felony", much less that you cant purchase a gun because you decided to dabble in drugs. It makes sense if the person had a violent background, even domestic violence..but drugs? Today there are many laws that I not only disagree with, but also see as being detrimental to the country itself...namely the pc laws."
So you still don't like some laws. I wouldn't trust you with a weapon. You were convicted of a felony. Now you are paying. That's the way it goes. You walked the walk.
Drugs can cause violence, even domestic violence. You weren't convicted of "dabbling" in drugs. You were more than likely convicted of possession or selling or something along those lines. There is no such charge as dabbling. Sorry! Anybody that has a connection of any kind with drugs should not own weapons. That may sound harsh, but my years as LEO taught me that people can go back to drugs very easily. It's not worth the chance giving a felon a weapon.
I have a friend who is serving two years in Fed Pen for a white collar crime. He signed a few reports saying he checked some wastewater on his job when in fact he hadn't. For that he is a convicted felon. He had to get rid of all his hunting rifles, ammo, anything to do with firearms to his son. That's nothing like doing drugs, but he'll have to live with it the rest of his life. He is now a convicted felon and always will be.
When he gets out I can't be with him with my weapon.
If you try to fail, and succeed, which have you done?

I don't believe that is the case. He is he felon, you are not. If I am wrong I really need to know about it too. As I understand it a felon is not allowed to purchase, own or posses a firearm, hanging out with you carrying your gun legally has nothing to do with him. Can you cite a statute that says otherwise? If you can, all I can say is "oops".

Parrot,
That was my understanding from an LEO here. However I will research it and get back to you. I was under the understanding that he could not be in the company of someone who is armed.

Re: 20 year old felony blocking purchase of gun
Heck, I went thru a hellava time before I (finally) got my Bersa. I have owned many firearms in my life, so I filled out the forms here (Oregon) and was totally surprised that I was denied when the gal at the FFL that I had it sent to told me that. They gave me a number and I called up the State Police who does the checking. The gal that answered was very snippy and said "weren't you arrested once in 1968?" I was like "excuse me"? She said "we show you were arrested once blah blah blah" I said, "ok, I was arrested once FORTY YEARS AGO and why is that record available now? I was told by the judge that since it was totally dismissed AND the state apologized for the error that it wouldn't be on the books" I said "I checked the box that askes if you have ever been CONVICTED of a felony" She said, "well we have to investigate now". We went round and round for TWO MONTHS until I got the OFF (gun lobby here) involved. The guy I talked to was totally pissed off and said they do this crap all the time. Bottom line is he got state reps involved, to the point where the REP called up the state police and said that he would come and pick up the gun himself and give it to me if they didn't deliver the gun to me. The state police used the lame excuse that they "had to make sure that domestic violence wasn't involved" Many don't realize that anytime domestic violence is invoked, BAM there goes your gun rights. So if your g/f or wife makes up a story and you get arrested, say bye bye to your guns.
So, if you have a local gun lobby, they can help (the NRA wasn't any help at all btw) along with your local representatives.

Re: 20 year old felony blocking purchase of gun
Consequenses of some actions are a bitter pill to swallow. I'm in somewhat agreement with Tnjack, especially the harder drugs. The cycle of drug users who were immersed in the lifestyle is hard to get out of. Seen people get in that mode and cycle in and out. I knew better even as a teenager it would mess you up, even the dabbling. Every circumstance is different but, sometimes you have to sleep in that bed you made. Good luck.
